美眾議員 提案恢復美台邦交

〔駐美特派員曹郁芬／華府八日報導〕美國德州眾議員麥考、強生與紐澤西州眾議員安德魯斯七日在眾議院提出一項決議案，呼籲美國政府與台灣恢復外交關係。台灣人公共事務會總會長高龍榮說，這個提案反映了美國國會中，越來越多人認同『一中政策』已逐漸不合時宜，並背離台灣為自由民主國家，應被國際社會接受為其平等及完整的一員的事實。

台灣人公共事務會在新聞稿中指出，這項由友台眾議員提出的議案敦促美國總統：（1）揚棄大有瑕疵的一中政策，改採符合現狀的「一中一台」政策，以承認台灣為一主權獨立國家；（2）開始有關與台灣復交的相關程序；（3）積極支持台灣完全參與聯合國「及要求有國家身分以入會的任何國際組織。」

該提案重申台灣關係法及六項保證為美台關係的基石，並闡述「台灣在過去五十多年來，是以一個獨立並擁有主權的國家在運行的事實。」決議文指出，美國政府目前在外交關係上，不承認五個國家：伊朗、北韓、古巴、不丹及台灣。其中，只有台灣是發展完全的民主國家。

強力支持台灣的前共和黨眾議員唐克多，曾在二○○五年與○七年中，兩度提出相似的決議案；共和黨籍長期挺台灣的林德，也於二○○九年未退休前提出類似提案。

漲價潮 倒閉潮 失業潮 
馬英九總統訪問布吉納法索時，看到學童在黑暗中趴在一盞燈下寫作業，對隨行記者「有感」而發說：你不覺得我們就是因為用電太便宜了，就不會像他們這樣重視，所以看看人家，想想自己，也許此行會讓我們產生一點點珍惜資源的感覺。馬英九到非洲如此「有感」，卻對國內民眾之於油電雙漲、物價飛揚怨聲載道完全「無感」，只想在出訪期間遙控電價調漲，避免直接面對抗議聲浪。有人形容馬英九像「何不食肉糜」的晉惠帝，還真的沒有冤枉這位宅男總統。
根據經濟部最新調漲方案，工業用電平均調幅為三十五％，商業用電平均調幅為三十％，住宅用電平均調幅為十六‧九％。有鑑於國內經濟並無「奇蹟式成長」，就業市場沒有實質復甦，國人的薪資所得且倒退回十三年前的水準，再加上國際能源價格也沒有劇烈波動，我們真的不了解此時此刻電價有何大幅調漲的理由。「電價不漲台電會破產」，一個口令一個動作，就要社會大眾把漲價「吞下去」，這是苦民所苦嗎？這是庶民經濟嗎？這是幸福內閣嗎？油價非漲不可，電價非漲不可，馬英九為何不在大選列入政見，反而以凍漲來騙選票？
一個負責任的政府，在電價大幅調漲之前，大者應通盤審視國內外產業經濟環境，小者應切實檢討台電的採購、生產、管理，是否有盡力做到降低成本，這一方面是替一般民眾節省荷包，一方面是強化產業的國際競爭力。如果不此之圖，平時任由台電不當浪費，出現虧損又要全民買單，那哪需要什麼高薪的專業人才，阿貓阿狗來做就可以了！在社會交相指責聲中，台電提出優退三百餘人，停止員工用電優惠，調降事務性費用，節省燃料採購成本等措施。其實，這些只是「省小條」，真正「開大條」的，尤其是採購成本、生產效益公諸於眾，接受嚴格的檢驗，台電不做就是不做。
根據台電本身估計，電價調漲後，每年約可增加一千億元營收，新電價實施後，今年稅前盈虧可由原預估虧損一一七六億元改善為僅虧損一五二億元。台電董事長陳貴明還說，若再計入浮動電價，他預期台電二○一三年可盈餘一七八億元、二○一四年可盈餘一四七億元。諷刺的是，前幾年有媒體披露台電購煤弊案，消基會當時赴監察院舉發稱，陳貴明在二○○八年因錯誤的採購燃煤決策導致鉅額虧損。而此案監察院剛進行分案準備展開調查之前，台電存放對外採購合約的倉庫，恰好發生竊案。台電還有多少這種離譜的事？台電的採購成本合不合理，採購合約的內容合不合理，至今都是「保密」項目，缺乏有效監督機制。這樣的經營模式，怎麼容許存在於民主法治的社會？
近年產業外移十分嚴重，目前留在台灣的中小企業獲利微薄，甚至處於待歇業狀態，油價大漲之後又面對電價大漲，可以想像許多不是被迫出走到中國，就是關門歇業。一旦倒閉潮出現，失業潮必定隨之發生，換言之，資方苦，勞方也苦。以現在的就業市場來看，馬政府慷納稅人之慨推出種種短期就業方案，才勉強讓失業率在政府統計上稍有美化效果。而體察民情的人都知道，失業問題仍非常嚴重。可以說，電價大幅調漲，害慘產業，也製造失業，乃「生雞蛋沒，放屎一大堆」，這絕不是「照顧民生」，而是「惡僕欺主」。
電價不是絕對不可調漲，只不過，調漲之前必須將台電的採購、生產、管理全部攤開來檢驗，讓社會大眾心服口服，絕對不能平時黑箱作業，出現虧損一聲令下要全民買單。而且，即使電價要調漲，也要顧全產業的生存與發展，讓有心在台灣經營的業者和勞工，能在自己的家園安居樂業。馬英九執政四年來，許多人已經過得很辛苦了，更沉重的壓力也許就是壓垮駱駝的最後一根稻稈。日前新北市一家四口，因為無法負擔基本生活費用而全家燒炭自殺，聲稱「調漲電價有利節能減碳」的馬英九不會感到慚愧嗎？難道，馬英九不惜「痛苦決定調漲電價」，也要讓更多企業倒閉、更多勞工失業、更多家庭走上絕路？

那請大家來看美國這邊給的證據!

何瑞元怎麼說大家早今天是2011年7月23日。這是1945年10月25日日本軍隊在台灣投降儀式後大約 66年。當時，顯然，許多人在世界各地，不完全了解這個日本投降儀式的法律意義，甚至於美國行政部門在以後的所發出的許多指令，備忘錄和其他法律文件，這個投降儀式的意義並不被完全確認。事實上，基於1907年的海牙規則，應該是100％的清楚， “領土被敵方的軍隊統治後，是屬於被佔領的領土。” 因此1945年10月25日的意義是台灣和澎湖列島軍事佔領的開始。儘管這是一個事實，但是當時有許多其他聲明和宣言左右浮動，並烙印在大家的意識裡頭，擾亂大家的思路，如開羅宣言，波茨坦宣言，以及某些在1945年9月2日日本投降文件的的語句!

    2在處理被佔領土方面，有三個核心問題，必須加以處理（1）佔領是什麼時候開始的？ （2）誰是佔領權國？ （3）佔領是什麼時候結束的？現在是2011年，大概只有在過去這十年左右，美國行政部門的很多單位，才開始了解到1945年10月25日的意義，係為台灣地區軍事佔領的開始。同時，越來越多參與了台灣問題研究的研究人員和學者也開始認知到，當天是台灣地區軍事佔領的開始!

3,然而，這些人不夠熟悉拿破崙時代後的戰爭慣例法來探索其他兩個問題的答案。因此他們立即做出不正確的假設，不知怎麼地，以為中華民國是在台灣的“佔領權國”，而且由於在過去 20多年，通過各種民主變革，大概也許台灣已經離開並終止軍事佔領的情況。這兩種假設是不正確的!

4在美日太平洋戰爭期間，所有攻打台灣和澎湖的軍事行動，都是美軍所為，美國損失大量軍人、軍艦及戰機，最後，日本國旗在台灣下降。因此，根據戰爭慣例法美國必定為台灣的佔領權國。如我們所看到的，中華民國﹝蔣介石﹞的軍隊是來處理台灣軍事佔領的任務，從而導致了一個委任與被委任或說主從關係。這個關係完全被1952年的舊金山和平條約認可。

事實上，1952年的舊金山和平條約裡頭，第23條（a）指明美國是主要佔領權國。同時我們知道，軍事政府是佔領軍對於佔領地區執行政府職權的管理當局型態。舊金山和平條約裡頭，第4條（b）使美國軍事政府對台灣有管轄權，以類似的方式，與其被賦予琉球群島的管轄權一樣!

5同時我們看到，第2條b指出，日本放棄對台灣、澎湖等島嶼的一切權利、權利名義與要求，從而導致的情況是日本放棄了對這些島嶼的權利，但沒有指定“收受國”。因此，台灣仍在美國軍事政府的管轄下為一個暫定狀況。從1952年舊金山和平條約生效到今天，沒有發生什麼事情改變了這種局面。美國至今仍然是台灣地區的主要佔領權國 !

我們全台灣的公民們要在2012/05/19/20-21日,一定要KMT狗黨瓦解!如民進黨或其他(在野黨)搞不過KMT狗冥黨的話!
