         因為中華民國政府本身就不是一個主權獨立的國家，它是一個流亡政府，最關鍵的一點就是中華民國從未擁有台灣島的主權，相對的菲律賓和中國都是屬於主權獨立的國家，而且國際法庭是要以聯合國組織會員國為準，舉一個非常簡單的例子，從1971年代表中華民國的國民黨被迫退出聯合國之後，就己經變成符合一個流亡政府的條件，只要中華民國的名號出現在任何的國際組織及民間活動的話，都會遭受到來自中國的打壓及抗議，中華民國流亡政府為什麼不敢向國際法庭對中國提出控訴呢？因為流亡政府是沒有任何資格及權力，向國際法庭要求向另一個主權獨立的國家提出指控！請各位別忘了，中國是有權力這樣做的，因為它代表了在聯合國永久的5個理事國之一的中華民國的席位！
